Federal Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention

A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks lawful basis.

"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to answer human smuggling allegations, he was detained in federal detention.

In her order, the judge noted that the government lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

The court proceedings involve disputed claims. While the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing trial in the state of Tennessee.

The judge, who was overseeing his challenge to removal in a Maryland district court, determined that he must now adhere to the conditions of his bond from jail in Tennessee. This decision shifts his monitoring to the Tennessee court.
